NYS Public Health Law and New York General Business Law

The Consumer Financial Protection Bureau (CFPB) has issued a final rule amending Regulation V, which implements the Fair Credit Reporting Act (FCRA), concerning medical information. The final rule is effective March 17, 2025 and covers patient use of credit cards for medical transactions, and how that information may be used by credit agencies. Per the new regulations, whenever a patient pays a medical bill using a credit card, they should be reminded of two points:

  1. Medical bills paid by credit card are no longer considered medical debt.
  2. By paying with a credit card, patients are forgoing certain federal and state protections around medical debt.

Family Health Network is required to obtain an acknowledgement from each patient that they are foregoing the following protections:

  1. Prohibitions on wage garnishment and property liens.
  2. Prohibition against reporting medical debt to credit bureaus.
  3. Limitations on interest rates.

In addition, at the time of enrolling in a payment plan, the patient will be asked to acknowledge the following:

  1. Prohibitions on wage garnishment and property liens.
  2. Prohibition against reporting medical debt to credit bureaus.
  3. Limitations on interest rates.

Please contact Family Health Network’s Billing Department at 607-753-3797 for any questions or clarifications.
